According to sections 96 and 97 of the Immigration and Refugee Protection Act, you will need Canada’s protection.

If your claim is accepted, you will have legal immigration status and may be eligible to obtain permanent residence for yourself and your dependent family members ,even if they are outside Canada.

CONVENTION REFUGEE – SECTION 96

A Convention Refugee is a person who has a well-founded fear of persecution in their country of nationality or, if they do not have a nationality, in their country of habitual residence, because of:

and is unable or unwilling to return to that country because of that fear.

PERSON IN NEED OF PROTECTION – SECTION 97

A person may be recognized as in need of protection if there are substantial grounds for believing that the person would be at risk, if returned to their country, of:

and the risk is in the context of generalized violence,
armed conflict, or where state protection is unavailable.
